Argument ends in shooting at Baden apartment complex

ST. LOUIS – A Spanish Lake man is in custody for allegedly starting an argument with another man and then shooting that person when things escalated.

According to the St. Louis Metropolitan Police Department’s probable cause statement, the shooting happened on August 4 at an apartment complex in the 8400 block of North Broadway, located in the Baden neighborhood.

Police said Jimmy D. Smith Jr., 34, walked up to the victim and started an argument, which led to a physical altercation. During the fight, Smith backed away and retrieved a gun. Smith fired several shots at the victim, striking him in the stomach, twice in the left thigh, and once in the right buttock.

The victim was hospitalized with critical injuries. Police did not provide an update on the victim’s condition.

Police said witnesses and video surveillance from the scene identified Smith as the shooter.

Smith was taken into custody on August 9. Police said Smith had a Glock 29 10 mm on his person and a Stoeger STR-9C 9 mm in his vehicle.

Casings from the scene of the shooting matched Smith’s Glock 29, according to investigators.

At the time of his arrest, Smith had a pending case in St. Louis County for three counts of possession of a controlled substance.

The St. Louis Circuit Attorney’s Office charged Smith with first-degree assault and armed criminal action. Smith remains jailed pending trial. His next court appearance is scheduled for August 20.
