Missouri Attorney General sues Florida-based realty firm for deceptive practices

JEFFERSON CITY, Mo. – The office of Missouri Attorney General Andrew Bailey filed a lawsuit on Wednesday against Florida-based MV Realty for deceptive marketing practices toward Missouri homeowners.

The suit alleges that MV Realty contacted Missourians and offered to pay them a small percentage of the value of their homes in exchange for a promise that the homeowner would use MV Realty as their broker whenever they sold their homes. MV Realty contacted thousands of Missouri homeowners, many of whom had previously registered their phone numbers on the state’s No Call List.

The attorney general’s office claims MV Realty sent notaries to meet Missouri homeowners, but the notaries said they couldn’t answer any questions about the proposed contract.

MV Realty failed to notify consumers that the contract would bind homeowners for 40 years and would be enforceable against their children or heirs after their deaths, and a lien would be placed on the property. The suit claims MV Realty lied to homeowners by saying they would not put a lien on their homes and they would never have to pay the money back.

The suit seeks relief for Missouri homeowners by directing MV Realty to remove existing liens, declare the agreements null and void, provide restitution to consumers who were unlawfully charged, and order the realtor to pay upwards of $213 million in fines and penalties for contacting Missourians on the No Call List.
